拒不履行信息网络安全管理义务罪的实质解释

基于刑事政策考虑增设的拒不履行信息网络安全管理义务罪,恐有实际扩大处罚范围之虞。站在刑法的实质主义立场,从利益衡量、行为可罚性及刑法谦抑性三个角度考虑,宜提倡在司法实践中审查涉案行政责令是否具有正当性。只有正当行政责令履行的义务与法律、法规规定的信息网络安全管理义务的交集才是本罪的作为义务,保证不值得刑事处罚的行为不在犯罪圈之内。
