The Legal Application of Marital Property Relations from Gender Perspective

婚姻法与财产法在调整夫妻财产关系时应如何衔接和适用,不仅困扰着司法实务界,学术界也是观点不一。夫妻财产关系的法律适用不能单纯地从法技术的层面进行逻辑推理,它要受到社会性别视角的制约。基于婚姻法本身具有保护妇女、保护弱者的价值取向,应将夫妻财产关系予以婚姻法进行特别规制,不能放任财产法"随意"入侵婚姻关系领域,这样才能促进夫妻关系的和谐,维护社会的稳定。

How should we connect and apply Marriage Law and Property Law in adjusting marital relationship is not only a controversy in the judicial practice, but also adisputed academic issue. The legal ap property plication of marital property relations cannot be purely logical reasoning from the aspect of law. It is also subject to the gender perspective from the society. Since the Marriage Law inclines to protect women and the weak, the marital property relations should be amended specially according to the Marriage Law. We cannot apply Property Law to marriage law all the time in order to promote the harmony of marriage, and to maintain the social stability.
