新常态下我国互联网保险有效监管体系研究

Research on the Effective Regulatory System of Internet Insurance Adapting to New Normal Status in China

新常态下,我国互联网保险发展迅速,各类新产品、新模式和新业态满足了互联网保险消费者的场景化、个性化和碎片化需求,也对风险管理和有效监管提出了新挑战。通过分析互联网保险面临的各种特定风险和固有风险,可以构建包括监管原则、监管模式、监管路径和监管技术在内的有效监管的完整框架体系。由四个层面构成的监管原则在体系中处于基础地位,对互联网保险监管具有指导意义。探索"监管沙盒"模式,可以为互联网保险创业机构和创新产品提供安全的"监管试验区",有利于实现金融创新与风险防控的平衡。而功能监管和行为监管则适应了混业经营条件下互联网保险跨区域、跨系统的特征,为持续监管提供了现实路径。最后,保险科技和监管科技的发展是互联网保险有效监管体系的重要技术支撑。

Internet insurance develops quickly under the new normal status in China. All kinds of new prod-ucts ,new patterns and new formats meet the scenic, individual and fragmental demands of internet insurance cus-tomers, but it also makes new challenges to risk management and effective regulation. Based on analyzing the spe-cific risks and inherent risks of internet insurance, this paper constructs a complete system for effective regulation, including regulatory principles, regulatory models, regulatory paths and regulatory techniques. The regulatory prin-ciples composed of four levels are the base for above system and have guiding significance to regulation. Exploration of 11 regulatory sandbox＂ model can provide safe test area for internet insurance innovations and realize a balance be-tween financial innovation and risk prevention. The functional regulation and conduct regulation adapt to the inter - regional and cross - system characteristics of internet insurance under the conditions of mixed operation, and pro-vide realistic paths for sustainable regulation. At last, the development of InsurTech and RegTech support this ef-fective regulatory system importantly.
