人民调解组织介入轻微刑事案件和解的“诸暨实践”——基于浙江省诸暨市检察院刑事和解的实证分析

发源于浙江省诸暨市的"枫桥经验",是我国刑事和解制度的成功范例之一。其依靠群众、注重教化的刑事司法思想与陕甘宁边区的刑事和解制度一脉相承,又有所发展和创新。浙江省诸暨市检察院委托人民调解组织参与刑事和解不管是在制度设计上,还是在司法实践中均具有一定的代表性,呈现出案件适用范围宽泛、配套机制健全、和解协议即时履行、人民调解组织与检察机关分工协作等诸多特点,并取得了积极效果,为推进社会组织参与基层社会治理、构建中国特色刑事和解制度提供了本土样本。
