情与法的交融：司法裁判中适用情理研究

Fusion of Passion and Law:Research on the Application of Passion in Justice

情理与法律之间存在对立统一的辩证关系,情理是法律的内在支撑,法律是情理在规范层面的升华。由于情理推断契合认识过程的一般规律,情理规则弥补了法律规范的局限性,且情理论证增加了司法裁判的可接受性,故而在司法裁判中适用情理存在正当性。基于对古代与当代司法裁判中运用情理的具体分析,指出当代司法实践中适用情理存在"司法裁判背离情理""情理适用对司法独立和权威提出挑战"两个问题。其解决措施在于,通过引情入法、以情释法、合情合理、情法分明等途径,实现司法裁判中情法关系的协调与交融。

There is a dialectical relationship of unity of opposites between passion and law. and law is the sublimation of passion on the level of rules. As the inference by passion agrees with the general rule of cognitionprocess,the rules of passion make up the limitation of legal norms. Furthermore,the argument of passion increases the accept-ability of judicial judgment, therefore it is justified to apply passion in judicial adjudication. Based the use of passion in ancient and contemporary judicial adjudication,it can be pointed out that current judicial practice,which are that “the administration of justice departs from passion” and that “the application of passiongives a challenge to the judicial independence and authority＂. The solution lies in achieving coordinsion and law in the judicial process by the ways of introducing passion into the law,interpreting law both with passion and reason,and distinguishing passion from law,etc.
