基于欧盟视角谈伊拉克和叙利亚文化财产的保护

The Protection of Iraqi and Syrian Cultural Heritage from the Perspective of the European Union

自伊拉克战争和叙利亚冲突以来,在武装冲突地区的文化财产正面临着恐怖分子的恶意毁坏、故意破坏及非法贩运。为了解决这一问题,联合国安理会和欧盟分别通过相关决议和理事会条例特别保护伊拉克和叙利亚的文化财产。文章介绍了联合国安理会的相关决议以及欧盟理事会条例及其法律基础,对安理会决议和理事会条例的保护内容和保护方法做出比较分析,建议扩大文化财产的保护范围和加强文化财产的保护方法。

Since the broke of Iraqi war and the Syrian Conflict, we are witnestruction , damaging and Hlicit trafficking of cultural property especially in situation of armed conflict. Inorder to solve this issue,the United Nation Security Council has adopted related resolutions andEuropean Union has passed related regulations specifically to protect cultural property in Iraq and Syria. This paper introduces the related resolutions of United Nation Security Council and the relatedregulations and their legal basis passed by European Union. Then, it continues to make a comparison o f the contents and approaches of culture property listed in resolutions and regulations. Finally, the papermakes a suggestion on increasing the protecting content and strengthening the apcultural property.
