论生效体育仲裁裁决的瑕疵与补救——以CAS仲裁规则为中心的考察

Defects and Correction of Valid Sports Arbitral Awards——Review Based on CAS Arbitration Rules

一裁终局制使仲裁裁决一俟生效即进入司法监督空间,仲裁庭因此不能对生效裁决再行补救之举。仲裁规则授权仲裁庭纠正形式错误,解释裁决模糊点,以及补充裁决,不可避免地导致生效裁决的变动或续造,从而涉嫌违反裁决既判力、终局性、仲裁庭履职理论,以及程序法治等仲裁基本原则。必须区分仲裁庭补救与改裁、新裁等近似现象,将其补救及其结论定性为原裁,同情考虑仲裁效率的功能本位,并严格限定在同一性、既得性和效率性等条件下实施。这为我国仲裁庭补救生效裁决之功能构造提供了重要参考。

Arbitral awards are subject to the judicial supervision after they come into force,and the arbitral tribunals cannot correct the awards.It is unavoidable that the awards are changes or recreated because the arbitration rules authorize the tribunals to redress formal error,interpret the ambiguity,and complete the awards.Therefore,it is possible to violate the principles of res judicata,finality,Functus Officio and procedural justice.Self-correcting,award-changing and awardredeciding should be differentiated so that the self correcting of award is the part of original decision.Together with efficiency of arbitration,they lay down the legitimate foundation for the self-correcting of awards.The self-correcting of awards should be carried out according to the requirements of consistency,vested content and efficiency,which is enlightening for China to establish the self-correcting mechanism of sport arbitration awards.
