摘要
近年来,侵犯公民个人信息案件呈现高发态势。然而,我国刑法对此类犯罪存在较多模糊性、概括性表述,导致入罪门槛不清晰、量刑标准不明确、信息数量认定难、自由裁量不当,掣肘司法人员准确适用法律。《关于办理侵犯公民个人信息刑事案件适用法律若干问题的解释》明确了实践中的争议问题、统一了刑罚的适用标准,为精准打击侵犯公民个人信息罪奠定了法律基础。为此,有必要结合办案实践,对侵犯公民个人信息案件的法律适用要义作重点分析,如公民个人信息分类制度、信息累计计算规则、直接认定规则、适用时效、合法经营的出入罪标准等,从而为准确适用本罪提供参考。
In recent years, cases of encroaching upon citizens＇ personal information tend to be on the rise. However, the criminal law in our country only has vague and conceptual explanation, which leads to difficulty in convicting the crime and unclear penalty standards, trouble in determining the information quantity, inappropriate discretion and hindering judicial officers from applying laws accurately. The Judicial Interpretation has made clear disputes in practice, unified penalty standards, which lays legal foundation of precisely combating the crime of encroaching citizens＇ personal information. As such, the paper, which is based on experience in dealing with such cases, analyzes applicability of the law, system classifying citizens＇ personal information, the rule of cumulative calculation of information, direct determination rule, time validity, standards of convicting crime concerning legal business, will provide reference for convicting such crime.
