By way of third party funding for arbitration,the commercial institutions support the arbitration proceedings in reward for certain profits. It was not very clear whether the third party funding for arbitration was allowed under Hong Kong law in the past. In recent years,there is a trend for some jurisdictions to consider legislating in this region. This paper will first review the developments of third party funding for arbitration in Hong Kong and England. Its possible implications on maritime arbitration are also to be discussed. This also provides for an example for the future legislating in China's Mainland.
