代孕是公民支配身体权的体现,有利于保障公民的生育权,合理应用并不会违背社会公序良俗。通过建立代孕者资料管理中心,实行代孕特许许可证制度;限定代孕双方当事人主体资格;设定代孕当事人的权利义务。在非商业性、保密、知情同意原则的基础构建代孕法律制度,防止被滥用,保护代孕当事人双方合法权益,造福于人类。

Surrogacy is a way to govern the right of body and protect reproductive right. If surrogacy is reasonably applied, it willnot be against public order and good customs. We can set up legal system of surrogacy by building the data center of surrogacy and licensing system, defining the qualifications of the parties of surrogacy, and setting rights and duties of the parties of surrogacy, which isbased on the principles of non-commercialization, confidentiality, and informed consent. The legal system of surrogacy can prevent theights of surrogacy from being abused,protect the legitimate rights and interests of the parties of surrogacy, and benefit humankind.
