关于男女平等基本国策相关问题的再思考

Reconsideration of Issues Related to Equality between Men and Women as Basic National Policy

什么是基本国策?法大还是策大?男女平等是不是基本国策?推动男女平等靠法律还是靠政策?法制与法治还有多大的距离?自1995年中国国家领导人在第四次世界妇女大会上明确提出男女平等基本国策的概念后,这些质疑、困惑总是不绝于耳。就法律与政策以及推动性别平等的相关路径进行新的思考,可以进一步厘清思路,在依法治国、依宪法治国,努力建设中国特色社会主义法治中国的进程中,切实发挥妇女的主体作用和生力军作用,并不断推进男女平等事业的新进程。

What is the basic national policy？ Which is superior,law or policy？ Is equality between men and women the basic national policy？ Is law or policy the basis to promote such equality？ What is the gap between the establishment of a complete legal system and the rule of law？ Since 1995,when Chinese national leaders explicitly put forward the concept of the basic national policy on equality between men and women at the Fourth World Conference on Women,such questions and confusion have been heard frequently. It is imperative to think anew about laws and policies and the related paths to promote gender equality. Thus,we can further clarify confusion and effectively give women their full play in the process of governing the country according to law and the constitution and of making efforts to build a socialist China with Chinese characteristics. Finally,equality between men and women gets fundamentally promoted.
