聚众犯罪是一种结构比较松散的群集犯罪行为。聚众情境是引发聚众犯罪的周围环境,在聚众情境中参与者情绪具有相互感染、相乘夸大的心理效应。在聚众激情状态下,个人行为表现出无意识、不自觉、从众等非理性特点,极易造成场面失控,导致严重的危害结果。对于聚众犯罪的刑法规制,应注重聚众犯罪的情境性特征,体现惩罚犯罪与保障人权并重的价值理念。

The mob crime is criminal behavior whose structure is loose. The gathering situation is the sur- rounding environment that causes the crime of assembling a crowd. In the gathering situation, the emotion of the participants has the psychological effect of mutual infection, multiplication and exaggeration. All offenders have the psychological characteristics of no feeling guilt, strong cohesion and comply with authority, which is easy to cause unconscious behavior out of control and serious harm results. Practice should be taken to play against the combina- tion way, manifest both penalty specification and humanistic care in the criminal control for the crimes.
