Research on Recognition and Enforcement of Foreign Arbitral Awards in Vietnam

越南承认与执行外国仲裁裁决的历史情况并不理想。有关外国仲裁裁决承认与执行的立法存在一些问题,比如仲裁裁决的国籍认定标准与国际做法不符、检察机关的过度干预等。司法实践中,法院倾向于采取保守的态度,拒绝承认与执行外国仲裁裁决的情况较多。对越南有关仲裁裁决执行的法律及其适用中出现的问题进行分析,以期为我国商人了解越南承认与执行外国仲裁裁决制度提供帮助。

The history of recognition and enforcement of foreign arbitral awards in Vietnam is not desirable. The rel- evant legislation on recognition and enforcement of foreign arbitral awards have are some problems, such as identifi- cation standard of the nationality of foreign arbitral awards is inconsistent with the international one, the excessive intervention of the People＇ s Procures, etc. In judicial practice, it often occursthat courts tend to take a conservative attitude and refusals to recognize and enforce foreign arbitral awards. Analyzing the Vietnamese law on enforcement of Arbitral Awards and its problems occurred in application, the paper hopesto help our businessmen understand Vi- etnam＇ s recognition and enforcement of foreign arbitral award system.
