湖南省非物质文化遗产知识产权保护研究

Research on Intellectual Property Right Protection of Intangible Cultural Heritage in Hunan Province

总体而言,对非物质文化遗产的保护与开发主要有两种模式:一是自上而下的行政保护模式,即通过政府以外部力量的推动;二是自下而上的知识产权保护模式,即通过知识产权法律制度对非物质文化遗产予以保护。在我国实践中,对非物质文化遗产的保护主要是通过行政保护模式进行传承和保护,而对知识产权保护模式的理论实践研究则远远不足。因此在研究湖南非物质文化遗产保护的过程中,先要立足于湖南省非物质文化遗产自身的特点和保护现状,找出其中存在的问题,再探索知识产权保护模式对非物质文化遗产保护的必要性和可行性,对比借鉴域外非物质文化遗产保护的法律制度,构建完善湖南非物质文化遗产知识产权保护的思路和措施。

In general, there are two main patterns of protection and exploitation of intangible cultural heritage： one is the top - down administrative protection pattern, with government pushing by the external force; and the other one is down - top intellectual property protection pattern, by implementing the intellectual property right system. The protection of intangible culture heritage in China＇ s legal practice mainly refers to the administrative approach. And the research of practice about an Intellectual property protection pattern theory is insufficient. Therefore, in researching the protection of intangible cultural heritage in Hunan, we should first find out the existing problems according to the characteristics and the status quo. And then, we explore the？ necessity and feasibility of the intellectual property right protection of the intangible cultural heritage. On the basis of comparative researches, we can learn from foreign experience to develop methods and measures of improving the protection of intangible cultural heritage in Hunan province.
