新型城镇化建设背景下传统村落的法治化保护探析

Legal Protection of Traditional Villages under the Background of New-type Urbanization

传统村落维系着中华文明的根,在国家新型城镇化加速发展的背景下,传统村落的保护极为迫切。目前的传统村落保护存在着法律定位不明、保护对象混乱、保护手段有限等问题。因此,有必要由全国人大制定一部有关传统村落保护的基本法,解决传统村落的法律定位、保护和发展的关系、规划等基本问题,为传统村落保护制定长效机制。同时,还应鼓励通过地方立法来保护传统村落,包括改变传统村落富集地区的城镇化考核方式、对传统村落进行分类保护、制定地方传统村落的保护标准等。

Traditional villages bear the root of Chinese civilization. With the accelerating development of new-type urbanization,it is very urgent to protect traditional villages. Currently,the protection of traditional villages is facing such problems as unclear legal regulations,confusing protection targets and limited protection measures. Therefore,it is necessary for the NPC to enact basic law on the protection of traditional villages so as to solve the problems of relationship between protection and development and planning,providing a long-term mechanism for the protection of traditional villages. Meanwhile,local legislation should also be encouraged to protect traditional villages including reforming the performance assessment of urbanization in areas with plenty of traditional villages,classifying and protecting traditional villages and establishing protection standard for traditional villages.
