我国科学数据权益保护问题及对策——基于共享政策的文本分析

Problems and Countermeasures of Scientific Data Rights Protection in China——Text Analysis Based on Sharing Policies

在科学数据大繁荣的背景下,科学数据共享成为趋势,同时科学数据权益保护问题凸显。运用文本分析法,从权益主体、权益分配机制、救济途径及安全与质量保证方面对多个科学数据共享法规或政策进行分析,针对存在的问题提出政府作为科学数据共享协调者,个别试点领域完善共享条例以及权衡科学数据的保密和公开三点对策。

Scientifc data sharing has become a trend under the background of scientifc data boom, and the problem of protecting the rights of scientifc data highlights. By using the method of text analysis, this paper analyzes the rules and policies of many scientifc data sharing from the aspects of the subject of rights, the distribution mechanism of rights and interests, the way of relief, and the guarantee of safety and quality. Some suggestions are put forward to solve the existing problems： The government is a scientific data sharing coordinator; improve the sharing rules in individual pilot areas; balancing the science data confdentiality and public.
