权力规制法治视域中的公安现场执法困境

Dilemma of the Scene for Law Enforcement of Public Security based the Rule of Law in the Vision of Power Regulations

从近几年发生的案例来看,公安现场执法似有陷入困境之虞。公安执法规范化建设所期待的"规则之治"未能如期而至,关于这个问题,"权力规制法治"范式有很高的解释力。要解决公安现场执法难题,须在增配公安部门权力资源和减缩公安事权两个方面着手,其中确保警察充分运用自由裁量权和分化剥离非警务活动是突破口。应当将包括公安现场执法工作在内的公安工作置于法治建设视域之中考量,达成新的发展共识。

In the cases of recent years, the public security organs-the-spot law enforcement seems to have a danger of getting into dilemina. The rule of regulation of standardization construction of public security law enforce- ment is not realized, the rule of law by Disciplining Power has great explanatory power. We should solve the prob- lems by increasing power resources and reducing transactions of police bodies, which ensure the police using discre- tion and stripping non-police activities is a breakthrough. We must put public security work included on-the-spot law enforcement in the view of the construction of rule of law and reach a new agreement of development.
