监察体制改革下检察权功能之辩

On the Function of Procuratorial Power under the Supervision System Reform

监察体制改革直接关联着司法职权优化配置。在检察机关职务犯罪侦查权向监察委员会转隶的改革中,产生某些检察权地位下降论。但检察权在国外却得到格外的尊重和发展应用,如欧盟提出构建欧洲检察院。贬低检察权容易产生诸多危害:一是不利于监察体制改革的顺利实施;二是不利于以审判为中心的刑事诉讼改革,包括不利于确立庭审的刑事诉讼中心地位和扭转侦查中心主义传统;三是不利于推进法治建设进程。法治发展史表明,检察权与法治之间有着"命运共同体"的密切关联。因此,有必要扭转不当观念,坚持以庭审为中心和加强检察监督并重,构建监、检、法三机关分工负责、互相制约、互相配合的刑事诉讼架构,这是司法规律和法治规律的应然趋势。

The reform of the supervisory system is directly related to the optimal allocation of judicial powers and functions. Some arguments belittle the status of prosecutorial power during the transfer of procuratorial organs＇ power of duty crime investigation to supervisory committee. However,procuratorial power has been especially respected and developed abroad,such as the proposition of European Union to build European Procuratorate. Belittling the procuratorial power is easy to cause a lot of harm： firstly,it is harmful to the smooth implementation of supervision system reform; secondly,it is harmful to the reform of the criminal litigation centered on trial,including the establishment of the central position of criminal proceedings in court and the change of investigation centrism tradition; thirdly,it is harmful to promote the process of the rule of law. There is a close correlation between the fate of the procuratorial power and the rule by law. Therefore,it is necessary to disabuse improper ideas,adhere to the central position of court trial and strengthen procuratorial supervision. Objectively,it is an inevitable trend of the judicial rules and the rule of law to construct the the criminal proceedings structure of division of labor,supervision and cooperation among the supervisory committee,the procuratorate and the court.
