论公安机关干预家庭暴力的现状及对策

On the Current Situation and Countermeasures of Police's Intervention in Domestic Violence

家庭暴力破坏家庭和谐,影响儿童健康成长,易引发恶性暴力事件,公安机关应积极干预家庭暴力。但是因为家暴案件自身有很强的隐蔽性和反复性,目前公安机关的干预行为存在执法力度不够、制裁措施不力,易入心理误区,调查取证难度大等困境。解决这些问题,应全面界定警察干预家庭暴力的职责,完善家庭暴力举证责任归属、形成规范的操作流程、紧密结合社区力量。

Familyviolence undermines family harmony,influences children＇s healthy growth,and causes serious violent incidents. Police should actively intervene in family violence. However,because the case of domestic violence itself has a strong concealment and repetition,there are problems such as insufficient law enforcement,ineffective sanctions,easily into misconceptions and difficult investigation during the intervention of police. To solve these problems,we should comprehensively define the responsibilities of the intervention in domestic violence,improve attribution of the burden ofdomestic violence proof,form standardized operation procedures,and closely integrate community forces.
