摘要
灵活就业已经成为新增就业的主渠道,灵活就业者社会保障权的实现问题面临着法律和现实的困境。政府应该承担其尊重和保护灵活就业者社会保障权的义务,坚持普遍和平等的价值理念,从宪法和法律层面完善灵活就业者实现社会保障权的各项制度,并建立社会保障权的救济机制。
Flexible employment has become the main channel for new employment, and the realization of flexible workers' social security right faces the dilemma of law and reality. The government should take on its respect for and protection of flexible employees' social security obligations, adhere to the universal and equal value concept, improve all kinds of system of social security from the aspect of the constitution and the law, and establish relief mechanism of the social safeguard right.
