现代环境法应融入中国本土传统伦理文化,儒法道墨四家伦理思想为我们提供了省思视角。"天人合一"的儒家伦理思想强调整体性,追求人与自然的和谐;"道法自然"的道家伦理思想可视为自然法,要求环境立法要遵循自然规律,促进生态学、环境科学规律的法律化;"兼爱交利"的墨家伦理思想揭示了以爱护自然为情感基础的生态伦理与具有经济伦理特征的生态经济法相契合;"一断于法"的法家伦理思想要求严格执法,对改变目前我国环境执法效率低下颇有启示。中国环境法律的立、改、废进程,应该融入中国传统文化伦理元素,汲取我国传统伦理文化的精髓。

China＇ s environmental law should be incorporated into the elements of traditional Chinese culture and ethics, and absorb the essence of Chinese traditional ethical culture.
