摘要
由于司法机关及司法权的特殊性,地方人大监督司法一直面临着抽象监督与具体监督的两难抉择。这就要求我们在抽象监督与具体监督之间,为地方人大监督司法划定一个合理的界限,以达到既保证地方人大及其常委会有效行使监督权,又保证司法机关依法独立公正行使司法权的目的。为此,地方人大监督司法工作的重心应实现三个转变:一是从个案监督到类案监督;二是从结果监督到程序监督;三是从形式监督到实质监督。
Given the particularity of judiciary authorities and jurisdiction, the local People's Congress always face the dilemma of abst ract and concrete supervision when conducting judicial supervision. It is necessary to set a rational limits of judicial supervision for local People's Congress when choosing from the two above, reaching such a state that local People's Congress and their standing committees can perform their supervision rights ef fectively and guarantee the judiciary authorities exercise jurisdiction legitimately and independent ly.Thus,there should be three transformations for local People's Congress: first, from individual supervision to parallel supervision; second, from consequential supervision to procedural supervision; third, from formal supervision to essential supervision.
