论地方政府简政放权改革中的权责关系调整——以A省省市县行政审批制度改革为例

简政放权作为当前行政体制改革的"先手棋",对转变政府职能,提高政府治理能力具有重要意义。简政放权,不是简单的上下级政府间放权与接权过程,更涉及权力、资源、责任、人员等内容在不同层级政府间的重新配置,实质是上下级政府间权责关系调整问题。本文以A省省市县行政审批权的下放与承接过程为例,对简政放权中上下级政府间关系调整问题进行分析,认为当前上下级政府间权力、责任、人员、资源的关系是一种不协调的状态,这种不协调的关系造成了政府间责权关系不一致、资源配置不到位、人员设置不合理等问题,成为制约简政放权的深层次因素。因此,深化简政放权需要均衡调整上下级政府间权力、责任、人员和资源关系,通过改革行政层级体制,合理划分政府间职责,重塑政府间关系,推动形成上下级政府间责权利一致的权力体系。

As the offensive move of current administrative system reform, streamlining administration and power delegation is of great signif icance to transform government function and promote government administrative capacity. This reform does not simply refers to the delegating and receiving power between superior and subordinate governments, what＇s more, it involves the reallocation of power, resource, responsibility, staff and other aspects between the superior and subordinate levels. In essence, it is the adjustment of authority-responsibility relationship between superior and subordinate governments. On the case of delegating and receiving administrative examination and approval power in the province, city and county of Province A, this paper analyzes the adjustment of authorityresponsibility relationship between superior and subordinate governments. The argument is that the unbalanced adjustment, which relates to adjusting power, resource, responsibility, and staff between superior and subordinate governments, results in lots of problems, such as the inconsonantauthority-responsibility, inadequate resource allocation and unreasonable staff set ting. All these problems become the underlying factors which const rain streamlining administration and instituting decentralization. Therefore, streamlining administration and power delegation needs to evenly adjust the relation of power, responsibility, staff and resource between superior and subordinate governments. Through reforming administrative hierarchy system, reasonably dividing governmental responsibility and remodeling relations between governments, our country could promote the formation of power system with consistent responsibility, power and benefit between the superior and subordinate governments.
