农村基层法治建设的困境与出路——以某市农村“精准普法”为例

The Predicament and Solution of the Law Construction in Rural Areas——Taking the Example of Accurately Promotion of the Law in Rural Area of City

某市力推大学生志愿者下乡"精准普法",并在具体的运作过程中取得了一定的社会效果。然而其过分依赖制度强行输入式路径,罔顾转型中国农村宗法残余严重、基层自治虚化等社会实情,导致该路径效能低下,反而进一步加大了农村基层法治建设的困境。惟有立足农村社会生活的实情,为农村基层自治提供智力支持,促进制度理性与社会土壤的耦合,方能为农村基层法治建设的困境找到一条相对合理的出路。

A city promotes college students volunteers go to the countryside to accurately promote the law and has achieved certain social effects in the specific operation process. However,its over-reliance on system forcibly inputting the path,disregarding the social facts such as the residual remnants of rural China＇s patriarchal clan system and the weakening of grass-roots autonomy caused the low efficiency of the path, but further increased the plight of the rule of law at the grassroots level in rural areas. Only by basing ourselves on the facts of rural social life and providing intellectual support for rural grassroots self-government can promote the coupling of institutional rationality and social soil so as to find a relatively reasonable way out for the dilemma of the rule of law at the grassroots level in rural areas.
