Jurisprudential Analysis of Arbitration Right of CAS

以国际体育仲裁院的仲裁法典为法律依据,结合具体案例,从仲裁权的视角分析国际体育仲裁院(CAS)仲裁权的法律属性、内容、行使程序等基本理论问题,从而明确CAS仲裁权的运作机制以及相对于一般仲裁制度的独特之处。从法律属性上,CAS仲裁权具有契约与司法权的双重属性,可以将其界定为一种社会司法权。主要内容包括仲裁管辖权、审理权、调解权和裁决权。CAS具有自己独具特色的程序机制,主要包括普通仲裁程序、上诉仲裁程序和奥运会临时仲裁程序三种。三种程序都包含了程序的启动、审理和裁决三个阶段,但各有特点。一般仲裁程序注重仲裁当事人的意识自治,与一般的商事仲裁制度类似;上诉仲裁程序是一般商事仲裁程序与诉讼程序的结合,是CAS仲裁权契约和司法权双重属性的典型体现;奥运会临时仲裁程序则具有即时性和灵活性等特点。

Based on the CAS Arbitration Code and combined with the concrete legal cases, the author analyzes the basic theoretical issues about Legal attribute, the contents and the exercise program from the view of arbitration power, by which the author describes the operation mechanism of CAS arbitration power and the uniqueness com- pared with ordinary arbitration. The CAS arbitration power has the dual attribute of contract and judicial power, which can be defined as a kind of social judicial power. The main contents include jurisdiction, hearing, media- tion, and adjudication power. The program of CAS arbitration is special, which includes ordinary arbitration pro- ceedings, the appeal arbitration proceedings, and the unique Olympic provisional proceedings. All the proceedings contain three stages, including the start -up, the trial and the verdict,but with their own characteristics. The ordinary arbitration procedure emphasizes the autonomy of the parties, similar to the general commercial arbitration. The appeal arbitration procedure is the combination of the ordinary commercial arbitration procedure and the litiga- tion procedure, which is the typical embodiment of the dual arbitrations of the CAS power. The provisional arbitration procedure of the Olympic Games has the characteristics of immediacy and flexibility.
