Process Sidelights on the Public Library Law of the People's Republic of China: Part One

《中华人民共和国公共图书馆法》建立了我国公共图书馆事业发展的基础法制框架,体现了一种立足当下的、理想与现实的平衡。对公共图书馆法2012年1月、2015年12月和2017年6月的3份公开征求意见稿,以及最终正式颁布的法律文本进行研读和比较,其中有关立法宗旨、法律调整对象、公共图书馆的定义与功能、公共图书馆事业发展的基本理念等问题的条文变化,反映了立法过程中围绕这些关键问题的思想交锋,体现了我国公共图书馆立法思想与时俱进的发展变化,体现了其对新时代中国特色社会主义事业转型发展的需要要的积极回应。但是,这部立法在支持民办图书馆发展等方面仍有其不足之处,有待进一步制定相关配套政策制度予以完善。

The Public Library Law of the People＇s Republic of China established the basic legal framework for the development of public libraries in our country and embodied a balance between the ideal and the reality based on the reality. The three public drafts of the Public Library Law of January 2012, December 2015 and June 2017 and the finally promulgated legal texts were studied and compared. Among the provisions of the key issues including the purpose of the legislation, the objects of legal regulation, the definition and function of public libraries, and the basic concept of the public librarlanship development, there are considerable changes, which reflect the ideological confrontations in the legislative process, and the development of the public library legislative ideas with the times, responding positively to the need of the transformation and development of public libraries in socialist society with Chinese characteristics in the new era. However, this legislation still has its Shortcomings in certain aspects, it needs relevant policies and systems to be further developed.
