我国体育非物质文化遗产的知识产权保护研究

Study on Protection of Intellectual Property Right of Sport Intangible Cultural Heritage in Minority Region in China

运用文献资料法,对我国体育非物质文化遗产的知识产权保护进行审视,针对体育的著作权、专利权、商标权、地理标志和商业秘密的保护现状进行研究。从知识产权保护的角度,剖析我国体育非物质文化遗产保护的不足之处。总结国外以知识产权法律制度、行政法以及知识产权特别保护制度保护体育非物质文化遗产的经验,并提出事先许可、事后禁止和传统群体享有体育非物质文化遗产的所有权和控制权三种模式,为完善我国体育非物质文化遗产的立法与知识产权保护提供理论参考。

Using the method of literature,examined the protection of intellectual property rights about sports intangible cultural heritage in our country.Research on sports copyright,patents,trademarks,geographical indications and protection status of commercial secret,from the point of intellectual property protection,this paper analyzed the shortcomings of the protection of the intangible cultural heritage of sports in our country.To summarize the experiences of protecting the sports intangible cultural heritage in foreign countries,according to the legal system of intellectual property,administrative law and intellectual property protection system.And it puts forward three modes of the prior permission,the prohibition afterwards and the traditional groups have the rights of enjoying the ownership and the right of control of legislation about intangible cultural heritage,and provides a theoretical reference for the improvement of sports intangible cultural heritage in our country and the protection of intellectual property.
