上海自贸区临时仲裁构建的合理性分析

Rationality of Construction of Temporary Arbitration in Shanghai Free Trade Zone

上海自贸区商事交易迅速增长,商事纠纷案件量也随之增多,且纠纷类型多样化、国际化趋向明显,需要我们建立一个更为多元的纠纷解决机制,而临时仲裁所具有的高效、自主、灵活等特征,正是可以成为自贸区商事纠纷的一条解决路径。尽管我国到目前为止并未对临时仲裁制度予以承认,但是也并未对该制度完全禁止,最高法司法意见及其他自贸区的实践亦增强了制度"落地"的可能性。构建上海自贸区临时仲裁制度,既要充分利用现有的制度土壤,又要以合理的制度创新发挥临时仲裁的制度优势。

With the business transactions growth in Shanghai FTZ, the number of commercial disputes has increased. The disputes tend to be diversified and internationalized,which needs to establish a more effective dispute resolution mechanism. The advantages of temporary arbitration is flexible, independent and efficient, which fit the needs of commercial disputes resolutions in Shanghai FTZ. Although our legislation does not explic-itly recognize the temporary arbitration, it leaves a chance for the Shanghai FTZ to build a temporary arbitration system. The opinions of the Supreme Court and the practice of other FTZs also enhance the possibility of con- structing a temporary arbitration system. Shanghai FTZ should not only make full use of the existing institutional conditions, but also exert the advantages of the temporary arbitration system.
