Study on Personal Information Leakage Prevention and Relief Mechanism in the Credit Field

美国和欧盟的相关立法从个人信息泄露的防范和救济两个方面入手,为个人信息安全保护在事前和事后都提供了有力保障,相关实践对完善我国在该领域的制度建设和监管手段具有较高的借鉴意义。应整合现行规则,借鉴域外经验,结合当前实际,完善个人信息泄露防范立法、加强全流程的信息泄露防范技术要求、借助行业监管优势提高监管质效、构建信息泄露通知规则、丰富信息泄露责任体系。

Based on the prevention and relief of personal information leakage,the related legislation practices of the United States and the European Union provides a strong guarantee for the security of personal information protection in both beforehand and afterwards respects. These practices are of high significance to the consummation of this field institutional construction and supervision methods in China. We should integrate the current rules,learn from foreign experiences,fully consider the reality,improve the legislation in preventing personal information leakage,strengthen the whole-process technology requirements for information leakage prevention,enhance the supervision quality and efficiency with industrial regulatory advantages,establish information leakage notice rules,and enrich information leakage liability system.
