近代渭南地区自然与社会生态剧烈变迁,水利纠纷成为乡村社会的主要矛盾,原"以例判案"的调节方式不再适用。随着相关法律的颁布,中国传统民事调节模式被改变;但因环境变迁,水利纠纷调节机制处于进退两难之窘境。即传统机制被打破,近代法制理念尚未构建,两种机制在错综复杂的社会关系中趋于游离,乡村控制力亦日益下滑。这表明中国传统乡村民治与现代城镇化民治不能以简单的继承关系来考量,必须考虑与其适应的生态环境。

The modern times Weinan area nature and the social ecology fierce vicissitude, the water conservation dispute becomes one of village society principal contradictions, original ＂decides a case by the example＂ the adjustment way no longer is suitable. Along with the correlation law promulgation, the Chinese tradition civil adjustment pattern is changed;But because of the environmental trend, the water conservation dispute adjusts the mechanism to be in the predicament in a dilemma. Namely the traditional mechanism is broken, the modem legal system idea not yet constructs, two kind of mechanisms tend to the dissociation in the intriguing social relations, the vil- lage controlling force also day by day glide down. This indicated the Chinese tradition village democracy and the modern urbanization democracy cannot consider by the simple inheritance relations, must consider the ecological environment which if adapts.
