电信网间互联法律制度的经济学分析

An Economical Analysis on the Legal System of Interconnection between Telecommunication Networks

电信业虽经多次重组,但仍没有形成竞争的局面。而网间互联的实现,是我国电信改革成败的关键。基于不完全契约理论,对我国电信网间互联法律制度进行分析,发现造成电信运营商之间履约率低的最根本原因是法律制定的不健全。针对于此,有必要采取如下措施:按照国际惯例认定主导运营商;引入互联合同范本制度;建立保证金制度;引入专家公开论证制度;直接规定人民法院具有司法管辖权。制定电信网间互联法律制度的目标不仅是电信运营商之间交易成本的最小化,还是保证社会福利的最大化。

Although the telecommunications industry has been reorganized many times,there is still no competition.The realization of internet interconnection is the key to the success of telecom in China.Based on incomplete contract theory,the analysis of the interconnection legal system of China's telecommunication network is the most fundamental cause of the low performance of telecom operators.In view of this,it is necessary to take the following measures;to identify the leading operator by international practice;introducing the interconnection model system;establishing a deposit system;introducing the system of expert public demonstration.It is not only the minimization of transaction cost between telecom operators,but also the maximization of social welfare.
