如何解决不动产统一登记中“中梗阻”等问题

不动产统一登记制度是近现代各国民法的一项重要制度和不动产的公示方式。不动产统一登记制度在我国全面落地实施以来,随着工作的不断深入,出现了许多"中梗阻"的现实问题。本文简单介绍各国的不动产登记制度后,总结了我国不动产统一登记的现状,紧接着从资源与环境视角为切入点归纳分析我国不动产统一登记还存在着历史遗留的问题、目前难以解决的问题和将来可能出现的纠纷问题。针对这三大棘手问题,通过文献分析法和吸收国外的先进经验,以及根据笔者在不动产登记中心所积累的经验,提出遵循以民为本,实事求是为原则的基础上,解决这些"中梗阻"现实问题的实际方法。

Real estate registration system is an important system of modern civil law countries and the publication system of been fully of the real real estate estate way of Since the registration has implemented in China, many problems have emerged with the deepening of the work. This paper first introduces the foreign real estate registration system, an Ch th d in then summarizes the status quo of a＇s real estate unified registration en from the perspective of resources and environment to analysis the problems which including history problems, the difficult to solve problems, and there will be a problem in the future. For the three problems, the author through literature study, absorb foreign advanced experience and and based on my experience of wor in the real estate registration center king put forward the ways to solve these problems under the the people-based and principle of following seeking truth from facts.
