Reflection and Recognition of the Particularity of Family Dispute

家事纠纷的特质是构建家事审判制度的理论基础,也是家事审判具体程序制度设计的依据,但目前对该问题的研究,缺乏统一的归纳标准、相互之间缺乏融贯性。其深层根源是基础问题意识不强、体系化思维阙如等。法律关系分析方法为家事纠纷特质的体系化研究提供了可靠的分析工具,由此将家事纠纷的特质表达为伦理性、较大的公益性、义务履行的主导性及争点的复杂性。

The particularity of family dispute is the theoretical basis of constructing family judicial system and al- so the design consideration of specific procedures of family judicial system. However, the existing research of this issue lacks the unified inductive criterion and coherence. The deep causes can be attributed to the insuffi- cient consciousness of basic issues and the absence of systematized thinking, and so on. The method of legal re- lation analysis provides a reliable analytical tool for the systematic study of the particularity of family dispute, which is expressed as the ethicality, the stronger public welfare, the dominance of duty performance, and the complexity of contention.
