《排污许可管理办法(试行)》对法律责任体系完善的探析

Discussion on Measures for Pollutant Discharge Permit Management ( Trial) to Perfect the Legal Responsibility System

排污许可制度是我国重要的环境管理制度,也是基础的污染物排放控制制度。排污许可证是排污许可制度的核心。已有实践证明,排污许可制度在一定程度上有效控制了污染物的排放,改善了我国的环境质量,但也存在着法律责任体系不够完整的问题。目前我国污染物排放的法律责任主要是超过排放标准和总量控制排放的法律责任。在此基础上,《排污许可管理办法(试行)》进一步明确了无证排污、超许可事项排污,以及违反信息公开、自行监测等义务应承担的多项法律责任,完善了污染物排放法律责任体系。

Pollutant discharge permit is an important environmental management system in China, and also the basis of pollutant discharge control system. Permits are the core pollutant discharge permit system. It has been proved that the pollutant discharge permit system can effectively control the discharge of pollutants. The system has improved the environmental quality of China. However, the system also has the problem that the legal responsibility system is incomplete. At present, the legal responsibility of pollutant discharge in China mainly includes two aspects. Firstly, the legal responsibility of exceeding discharge standards. Secondly, the legal responsibility of exceeding total quantity control of major pollutants. Based on this, the Measures for Pollutant Discharge Permit Management （Trial） clarifies the legal responsibility of unlicensed discharge, discharge of exceeding license items, violation of information disclosure obligations, self-monitoring, and other legal responsibilities. The Measures for Pollutant Discharge Permit Management （Trial） will improve the legal responsibility system for pollutant discharge.
