摘要
我国警察执法监督在程序启动、主体介入、对象内容、过程参与等方面亟待完善。在监督体系上尚不严谨,存在内部监督中立性不足、同体监督公信力不足、异体监督实效性不够等缺陷。当前应以行政检察改革和国家监察体制改革为契机,充分发挥检察机关和监察机关对警察权控制的功能优势,明确检察监督和监察监督的权限分工、程序方式和衔接制约机制,形成重大复杂警察执法争议案件对事对人双保险、违规违纪违法犯罪全程覆盖的新型监督模式。
The start-up of procedure,intervention of the subject,scope of the object,and process participation in China's supervision of police law enforcement need to be improved. There are defects such as impreciseness of the supervision system,lack of neutrality and credibility in internal and consubstantial supervision,and lack of actual effect from external supervision. It is suggested that China should take the opportunity of the reforms of administrative procuratorial supervision and the national supervision system to fully realize the functional advantages of procuratorates and supervisory commissions in regard to police power control. The purview of power,the procedures and protocols,and a system of link and check of procuratorates and supervisory commissions must be defined. A new supervision model towards grave and complicated disputes in police law enforcement should be established so that double safety for person and fact can be ensured and full-process supervisory coverage of violation of regulations,disciplines,civil,administrative and criminal law can be formed.
