On Interest Game and Balanced Principle of Local Legislation

随着社会转型的纵深发展,利益多元化不断被释放,不同利益之间的博弈不断深化。2015年《立法法》的修改,赋予全国设区的市都拥有地方立法权,使得不同利益主体间的利益博弈进一步显现和复杂化。如何对各种利益博弈现象进行分析,达到利益间的均衡是摆在地方立法机关面前的一个难题。为了实现地方立法的目标,协调各种利益冲突,确立利益平衡原则是立法者首先要解决的一个问题。

With further development of social transformation,diversification of interest is released,the game between different interests deepens. Amending of Legislation Law in 2015 has given legislative powers to Prefectural-level cities. The interests of different stakeholders of the game is exposed and complicated. It is a problem for the local legislative body to analyze various interests of the game and achieve the balance between the interests. Achievement of local legislation goals,harmonization of interest conflicts and establishment of interests balance principals are questions that lawmaker must first solve.
