行政级别、身份性质与我国受贿罪的量刑差异

对于这样的认识或质疑：受贿罪量刑的轻重与犯罪人曾经的行政级别和身份性质有关,如行政级别越高量刑越轻。模型的回归分析结果显示：受贿犯罪人＂行政级别＂的高低和＂身份性质＂的不同,对受贿罪量刑轻重的真实影响程度有限。进一步检验发现：受贿犯罪人＂编外人员＂和＂亲朋好友＂的身份,会影响到受贿罪量刑差异的存在,但这种差异的存在有其合理性。研究结论表明：量刑过程的不公开和理由的不公布,是导致社会公众产生上述认识或质疑的重要原因。有鉴于此,建议试点特殊受贿犯罪案件的＂量刑听证＂制度,增加受贿罪量刑的公开度和透明度,提高社会公众对受贿罪量刑结果的信任度。

For this understanding or question ： the sentencing of the accepting bribes crime has a relation- ship with the administrative ranking and status, for example, the higher the administrative ranking, the lighter sentence,. Regression analysis results of the models show that the influence of differences of ＂administrative ranking＂ and ＂status＂ on the sentencing of the accepting bribes crime is actually limited. Further studies show that the identities of ＂off- staff workers＂ and ＂relatives and friends＂ lead to the disparity. But the existence of this disparity is reasonable. Research conclusions indicate that no public sentencing process and reasoning is an important reason for the question of the public. So, it is necessary to establish the sentencing hearing proce- dures for the special cases of the accepting bribes crime, increase the degree of openness and transparency of the sentencing, and improve the public confidence in the outcome of sentencing.
