庭审中心主义视角下的行政审判流程再造

Reconstruction of Administrative Trial Process Under the Perspective of Court Trial Centralism

在行政诉讼中实行庭审中心主义对于推进以审判为中心的诉讼制度改革、发挥行政审判职能作用、完善行政审判特色制度具有重要意义。落实庭审中心主义可以从优化行政审判程序、完善行政审判流程的角度切入,依靠程序的正当性促进司法公正和司法公信,依靠程序的自治性隔断外部不当干预,依靠程序的制约性防止法官偏私偏信,依靠程序的参与性保障直接言词原则的落实。当前行政审判流程还存在衔接不紧、主体不分、久拖不决等问题,严重制约了庭审中心主义的落实。对此,应当以排除行政权力干扰、保持行政审判独立性、提升司法公信力为目标导向,对行政审判流程进行科学再造,通过设立独立的庭前准备人员和职能,突出庭前准备对于庭审的基础保障作用,通过实行即时分案、即时开庭、即时合议、当庭宣判,实现以庭审环节为中心的无缝化、集中化审理。

The implementation of court trial centralism in the administrative litigation has important signif- icance to promote the reform of the trial - centered procedure system, play the functions of administrative trial, and improve the characteristic system of administrative trial. To carry out the court trial centralism from an an- gle of optimizing administrative trial procedure, and perfecting the administrative trial process, relying on the promoting judicial justice and judicial credibility which depends on the legitimacy of trial procedure, the sepa- ration of improper intervention which depends on the procedural autonomy, preventing judge＇ s partiality which depends on the procedural conditionality, implementing the directness principle and the verbalism principle which depends on the procedural participation. The current administrative judicial process still has the prob- lems of incongruous coherence, subject confusion, and delay decision, which seriously restrict the implementa- tion of the court trial centralism. We should eliminate administrative power interference, maintain the independ- ence of administrative judicial, and improve the judicial credibility as the goal orientation, and make scientific redesign of administrative trial process. We should establish independent pretrial preparation function and staff, highlight the basis role of pretrial preparation, and realize the seamless and centralized trial based on the court -centered procedure by implementing the instant case distribution, instant trial, and instant deliberating case and court pronouncement.
