随着近代社会转型和城市社会的发展,传统的宗族社会控制模式逐渐失效,近代中国政府被动引入西方社会组织治理模式,社会组织成为城市社会治理的主体,这种治理体系弥补了近代中央权威衰微以及社会多元化治理的不足。上海律师公会治理严格依据国家颁布的律师章程和律师公会制定的律师公会章程两大规范,建构了三级组织机构的公会治理体系,每一级机构都出台了详细的民主议事规则或办事细则,一切会务依照规定分别交由不同机构办理。上海律师公会严格依法进行了民主规范治理,逐渐成为其他律师公会仿效的榜样。上海律师公会在治理中,还得到了国家的大力支持与配合,并与国家进行了良性互动。

With the transformation of modern society and the development of urban society,the traditional control mode of clan society gradually became ineffective.In modern times,the Chinese government passively introduced the western social organization mode of governance,and social organizations became the main body of urban social governance.This governance system made up for the decline of central authority and the deficiency of diversified social governance in modern times.Shanghai Lawyers Guild was governed strictly based on the lawyers statute promulgated by the State and the lawyers guild statute established by the Lawyers Guild,and established a guild governing system with three levels of organizations.Each level of organizations promulgated detailed rules for democratic discussion and procedures for handling affairs,and all affairs were handed over to different organizations according to the regulations.Shanghai Lawyers Guild conducted democratic norms governance in strict accordance with the law,and gradually became a model for other lawyers guilds.The governance of Shanghai Lawyers Guild also received the vigorous support and cooperation of the state,and conducted sound interaction with the state.
