国家监察体制改革背景下职务犯罪检察职能定位与机构设置

Duty Crime Inspection Function and Institutional Setting up under the Context of the State Supervisory System Reform

在国家监察体制改革全面实施、检察机关反贪反渎和预防部门转隶监察委员会的情势下,认清检察机关司法反腐的职能定位,科学设置职务犯罪检察内设机构,实行决定逮捕与审查起诉一体的工作模式,依法配置侦查、逮捕、公诉、立案监督、调查监督、审判监督等职权,是"形成监察机关与司法执法机关相互配合、相互制衡的工作机制",是充分发挥检察机关在党和国家反腐败总体格局中职能作用的必然选择。

Under the context of the state supervisory system reform,we must clearly recognize that understanding better the function of the procuratorial organ,scientifically establishing internal organizations of the duty crime inspection,carrying out the new work style of arresting while initiating inspection litigation,and legally distributing the power of arrest,public litigation,case supervision and investigation supervision that are the only option that form the mutual coordination and mutual check and balance between supervision organ and judicial implementing organ by which can play better role of procuratorial organ in the cause of anti-corruption of both the Party and the State.
