司法考试改革视角下高校法学专业教学改革探究

On the Teaching Reform of Law Major in Universities from the Perspective of National Judicial Examination Reform

国家统一司法考试是法律职业人资格考核的一部分,主要以培养应用型人才为主。法学教学是造就法律人的一个最重要的途径,主要以培养理论为主的综合型人才为目标。近些年来,二者关系愈加紧密,既有互动也有影响,但均以培养法律思维为根本基点,以培养成就法律职业人为目的。尤其在司法考试改革后更应权衡二者关系,求同存异使二者的作用发挥到最大化。

National Unified Judicial Examination is part of the legal professional qualification assessment,mainly aimed at cultivating application-based talents.Law teaching is one of the most important ways to train a legal person,mainly aimed at cultivating theory-based comprehensive talents.In recent years,the relationship between the two has become closer,interacting with and influencing each other.Both are based on the cultivation of legal thinking,taking training the legal profession as the purpose.Especially after the reform of National Unified Judicial Examination,we should strike a balance between the two parties,and seek common ground while reserving differences so as to maximize the role of the two.
