法制视角下对我国兽药监管的审视

Analysis on Veterinary Drug Supervision of China from Legal System Perspective

兽药规范化的实现需要有较为完善的法律机制。在法制视角下,从认知层面对兽药质量安全形势进行剖析,审视我国兽药质量安全法制监管现状。从顶层制度设计、基层管理需求、兽药司法监管、安全风险应对机制等方面综合分析了兽药管理的若干问题,提出我国兽药质量安全法制监管应审查现行兽药管理法律法规,并适时修订兽药法律规章制度,逐步开展网络监督,建立兽药质量安全风险预警机制,强化兽药安全司法监管,探求制度化、常态化和长效性的监管举措等建议。

A comparatively perfect legal system is necessary for realization of veterinary drug industry standardization. Here,from the perspective of the legal system,the quality and safety situation of veterinary drugs were analyzed at the conceptual level,and corresponding legal supervision situation were also described. Subsequently,the problems existed in veterinary drug supervision were discussed from the aspects of top-level system design,grass-roots supervision requirements,judicial supervision of veterinary drugs and the response mechanism of security risk. In the end,some suggestions were put forward for veterinary drug supervision authorities： investigating and examining the current laws and regulations of veterinary drug supervision,revising these laws and regulations properly and timely,carrying out internet supervision gradually,building the early warning mechanism,strengthening judicial supervision of veterinary drugs,as well as exploring the systematized,normalized and long-term supervision measures.
