On Xie Juezai's Legislative Thought

谢觉哉是中国近现代新民主主革命和社会主义建设过程中涌现出来的杰出法学家。其立法思想主要体现在三个方面。一是坚持实事求是原则,从实际出发,从国情出发,努力探索马克思主义立法理论与中国具体国情的结合。二是坚持法律的阶级属性,在立法中充分体现人民意志,努力通过人民立法构建社会主义中国的法律体系。三是尊重法律自身的规律,在立法过程中兼顾法律的时代性与稳定性,注重充分运用发挥立法技巧,同时注意将立法与司法相紧密结合。

Xie Juezai was an outstanding jurist who experienced both the new democratic revolution and the socialist construction.His legislative thinking can be mainly expressed in three aspects.The first is to insist on the principle of seeking truth from facts,or in other words,to explore Marxist’s legislative theory with the combination of China’s actual situation.The second is to insist on the class attribute of law.The will of the people should be reflected in legislation on which to constitute our socialist legal system.The last is to respect the law of law itself.Both the contemporaneity as well as stability are taken into consideration and at the same time the close combination of legislation and judicature are paid attention to.
