摘要
当前我国住宅质量缺陷责任承担和维修赔偿问题已成为社会关注的焦点,而如何构建一套完善的住宅质量责任承担和维修赔偿体系是解决该问题的关键。质量责任保险是明确质量缺陷法律责任,维护业主利益的一种经济手段。在阐述我国住宅质量缺陷和质量责任保险现状的基础上,分析我国住宅质量保险试行特点和问题。结合国情,依据法律法规提出住宅质量责任保险的设计方案,初步构建住宅质量责任保险的责任体系、风险控制体系和维修赔偿体系。利用经济学分析施工企业在项目启动时就投保,实施风险控制的重要性,引入工程质量安全风险管理机构对质量缺陷风险进行全过程监控。最后,针对健全住宅质量责任保险体系提出相关建议,为我国开展住宅质量责任保险提供启示。
At present,the issue of responsibility and maintenance of residential defect in our country has become the focus of social concern. How to construct a perfect housing quality responsibility and maintenance compensation system is the key to solve the problem. Quality liability insurance is an economic means of clarifying the legal responsibility of quality defects and safeguarding the interests of the owners. On the basis of elaborating the current situation of housing quality defects and quality liability insurance in our country,this paper analyzes the characteristics and problems of residential quality insurance in China. Combined with the national conditions,according to laws and regulations put forward the design of residential quality liability insurance program,the initial construction of residential quality liability insurance system,risk control system and maintenance compensation system.The use of economic analysis of construction enterprises in the project at the start of the insured,the implementation of the importance of risk control,the introduction of engineering quality and safety risk management agencies to assess the quality of the whole process of risk defects. Finally,the author puts forward some suggestions on perfecting the quality insurance system of residential property,and provides enlightenment for the construction of residential quality liability insurance in China.
