基本药物制度治理困境及法治化保障研究

Study on the dilemma of the administration of Essential Medicines System and legal protection

基本药物制度在实施中面临着治理困境与挑战,主要表现为:现有法律执行依据强制力不足、基本药物目录的法律权威性不足、遴选机制处于不合理状态、采购机制合法性问题凸现、缺乏法定使用机制、财政补偿不到位、缺乏有效的法律监督管理机制。建议在制订《基本医疗卫生法》时,应从宏观、科学的顶层设计角度对基本药物制度作原则性、框架性的规定,明确基本药物目录的法律地位,科学、公开、透明的遴选基本药物,改善基本药物的招标采购制度,法定基本药物的使用,确定合理的补偿机制,完善基本药物监管机制。

The implementation of the essential medicine system in China faces problems including the lack of compelling force of the existing law,Lack of legal authority on the essential medicine list,the unreasonable selection mechanism of medicines,the appearance of problems about the medicine procurement mechanism legalization process,lack of legal use mechanism,the unreasonable financial compensation mechanism,and the lack of effective supervisory regulation mechanism. Therefore,it is recommended that when formulating the basic medical and health law,the essential medicine system should be constructed under the ethical and framed stimulation from a macro and scientific point of view. It is also suggested that the legal status of the national essential medicine list should be defined,scientifically selecting the essential medicines,improving the essential medicine bidding procurement system,using the essential medicines under the appropriate law,determining the reasonable compensation mechanism and improving the essential medicines regulation mechanism.
