我国海水养殖保险合作社制度设计

System Design of Marine Aquaculture Insurance Cooperative System in China

由于海水养殖行业的高风险性,我国海水养殖保险领域呈现出保险组织有限、风险保障能力不足的现状。保险合作社作为一种传统的保险组织形式在我国已经具备了一定的法律和实践基础,可以作为弥补当前我国海水养殖保险市场不足的一条有效途径。在深入研究中美两国保险合作社实践和理论创新后,结合我国传统合作社的特征和美国新一代合作社和有限合作组织的制度创新,从性质界定、组织原则、组织构架选择等方面设计了我国海水养殖保险合作社制度,特别是在区分普通社员和投资社员资格的基础上对决策机制、社员准入及管理机制和分配机制等方面进行了详细规划。

Due to the high risk of marine aquaculture industry, China＇s aquaculture insurance has inadequate insurance organization and insufficient risk insurance supply. As a traditional insurance organization, insurance cooperatives, which already have certain legal and practical basis in China,can be used as an effective way to make up for the shortage in marine aquaculture insurance market. After doing deep research on the practice and theoretical innovation of insurance cooperatives in China and America, this paper designs the Chinese insurance cooperative of marine aquaculture, which includes definition of nature, the organization principle, choice of organizational structures, by combining the characteristics of traditional cooperative and the system innovations of the new generation cooperatives and the limited cooperative associations in the United States. It especially illustrates the decision-making mechanism, membership access, management mechanism and distribution mechanism of the system based on difference between ordinary members and investment members.
