加罗法洛自然犯罪理论的借鉴与反思--以自然犯罪与法定犯罪一体化立法为视角

On Natural Crimes of Baron Raffaele Garofalo——From the Perspective of the Legislation Integration of Natural Crimes and Statutory Crimes

加罗法洛最早提出了"自然犯罪"与"法定犯罪"的概念,并采用了一种法学之外的社会学方法去研究犯罪问题,对犯罪人的特殊预防起到了更好地促进作用,我国刑法典在变革的过程中可以借鉴此种分类标准,解决一直以来的混同弊病。但加罗法洛的自然犯罪理论中存在情感自身的模糊性、违法性意识的处理以及非犯罪化归类等欠妥的地方,需要在实践和理论上批判性的继承。

Baron Raffaele Garofalo firstly put forward natural crimes and legal crimes, and he has adopted methods of sociology to ana-lyze criminal problems that promote special protection of the offenders. In the process, this classification standard can be reference for the reform of the crime code to solve the confusion. However, some defective aspects still exist on the confusion of emotions and the awareness of the illegality in the natural crimes and they are practically and theoretically inherited critically.
