论基本医疗卫生法立法模式的选择

制定《基本医疗卫生法》已经列入国家立法规划,立法模式的选择是立法工作必须首先解决的问题。针对世界范围内存在的集中立法和分散立法两种模式,本文从分析集中立法模式能否适应我国医药体制改革的现实需要出发,认为该模式在厘清基本医疗卫生服务的边界,保证法律颁布后的有效实施,协调现有卫生法律体系内部关系三个领域都无法提供满意的回答。建议根据我国实际情况,采用分散立法模式,积极稳妥地推动医药卫生体制改革的进程。

Aiming at the existence of the world within the scope ofconcentrated and scattered legislation two modes, based on the analysis of centralized legislation mode can meet the need of the realityof medical system reform in our country, think this pattern in clarifying the boundary of the basic medical and health services, to ensurethe effective implementation of the law introduced, coordinate the internal relationship between the three areas existing health legal system can provide satisfactory answer. According to the actual situation of China, the paper proposes a decentralized legislative model toactively and steadily promote the reform of medical and health system.
