摘要
《劳动合同法》受到的质疑基本在于认为其过于倾向保护劳动者而忽视市场规律和用人灵活性;《劳动合同法》作为社会法,在权利配置方面实际也理应存在倾斜性,一方面是要从观念上把握倾斜立法与倾斜性权利配置的区别,另一方面是坚持倾斜性权利配置在《劳动合同法》中的必要存在;减少《劳动合同法》质疑之声的关键在于把握倾斜的度,即在尊重合同自由原则和契约自由精神的前提下,倾斜考虑劳动者"最低需求"的生活保障条件;在这一限度标准的框架内,现有《劳动合同法》的确存在"失度"之处,应该针对这些不足做出适当调整和修订。
The law of labor contract was strongly questioned because it was considered to protect the laborer too much and ignored the market rules and flexibility;as the law of society,this law does and must be tilted;the way to solve such a kind of problem was to control the limitation of tilt that was "in the premise of respecting the principles of freedom of contract spirit,to make sure laborers' minimum requirements life adjustments to the safeguard condition will be protected";within this framework,make appropriate law of labor contract.
