摘要
由于仲裁的自身局限性,商事仲裁应当被监督。国内司法监督的范围应当仅限于影响公正的纯粹程序性监督,而非全面监督。国内司法监督范围是国际商事仲裁监督体制选择的先决条件,划定国内司法监督范围使国内、涉外司法监督内容趋于一致,我国国际商事仲裁司法监督体制应当试行"单轨制"。我国《仲裁法》应当修改仲裁监督范围,解决当前司法监督范围和监督体制问题。
Because of the limitation of arbitration, commercial arbitration should be supervised. The scope of domestic judicial supervision should be limited to procedural supervision that affects justice rather than full supervision. Scope of domestic judicial supervision is the prerequisite of the selection of international commercial arbitration and supervision system, and delimiting the scope of domestic judicial supervision and making domestic and ~oreign trading affairs judicial surveillance content uniformity is of great significance. Thus, China's international commercial arbitration and judicial supervision system should have a try of the system of "single supervision". Therefore, China's arbitration law should amend the scope of arbitration supervision and solve the problems existing in the current scope of judicial supervision and the supervision system.
